Terms & Conditions
These terms and conditions (“Terms”) apply to your use of the “Arana Assistant” application (“Application”) provided by Arana AI UG (haftungsbeschränkt), Edelweißstraße 13, 82194 Gröbenzell (“we,” “us,” or “our”) and set out the terms on which you agree to use the Application. By using the Application, you agree to be bound by these Terms. If you do not agree to these Terms, you must not use the Application.
Access and Use
We reserve the right to withdraw or restrict access to the Application at any time and without notice. You agree to use the Application only for lawful purposes and in a manner that does not infringe the rights of, restrict, or inhibit anyone else’s use and enjoyment of the Application. You agree to use the Application responsibly and agree to fair use, which means no excessive or automated messaging or any other activity that could be harmful to our company or its image.
Intellectual Property
Ownership
The Application and all underlying intellectual property rights, including but not limited to the software, design, text, images, and graphics are owned by us or our licensors. You acknowledge that these rights are protected by intellectual property laws and treaties around the world. All such rights are reserved.
User-Generated Content
While using the Application, you may generate content (“User-Generated Content”). You retain ownership of any intellectual property rights that you hold in that User-Generated Content. By generating content, you grant us a worldwide, non-exclusive, royalty-free license to use, store, display, reproduce, modify, create derivative works from, and distribute such User-Generated Content solely for the purposes of operating, developing, providing, and using the Application. This license does not grant us the right to sell User-Generated Content or otherwise distribute it outside of our Application.
Use of Content
You are permitted to use the User-Generated Content created by you in the Application for personal or commercial purposes. For clarity, while you may freely use the content you generate through the Application, you must not use the Application’s own content, features, or functionality for any purpose other than as expressly permitted by these Terms, without our prior written consent.
Restrictions
You may not, without our prior written permission, use any part of the Application or its content for commercial purposes or in any way that infringes on the rights of others or violates applicable laws.
Content Within the Application
Notwithstanding the above, all content, features, and functionalities within the Application that are not User-Generated Content, including any updates or enhancements thereof, remain the property of our company or our licensors.
Data Storage
The Application uses servers located in Frankfurt, Germany, provided by Amazon Web Services (“AWS”), and you agree that your data will be transferred to, stored, and processed in Frankfurt, Germany. You agree that your use of the AWS services is subject to the terms and conditions of AWS. We are not responsible for the performance, reliability, or security of the AWS services and we assume no liability for any errors, omissions, or defects in the AWS services.
Services and APIs
For technical reasons, certain services within the Application may route data through servers located outside the European Union. However, we take all reasonable steps to ensure that your data is handled in compliance with GDPR and applicable laws. Where possible, any data sent to third-party services is anonymized to ensure that it cannot be traced back to individual users.
The Application uses APIs provided by Anthropic, Astica, Deep Infra, Elevenlabs, Groq, Lemonfox.ai, Meta, Microsoft, PlayHT, Serper.dev, Together Computer and OpenAI located in the United States and the European Union (EU). You agree that your use of the APIs through our Application is subject to the terms and conditions of Anthropic, Astica, Deep Infra, Elevenlabs, Groq, Lemonfox.ai, Meta, Microsoft, PlayHT, Together Computer and OpenAI. We are not responsible for the content or services provided by Anthropic, Astica, Deep Infra, Elevenlabs, Groq, Lemonfox.ai, Meta, Microsoft, PlayHT, Serper.dev, Together Computer and OpenAI through their APIs, and we assume no liability for any errors, omissions, or defects in the content or services provided by the APIs. By using the Application, you explicitly consent to the routing of your data through third-party services such as Anthropic, Astica, Deep Infra, Elevenlabs, Groq, Lemonfox.ai, Meta, Microsoft, PlayHT, Serper.dev, Together Computer and OpenAI for the purpose of providing you with the functionalities offered by the Application.
Liability and Indemnity
To the maximum extent permitted by law, we exclude all representations, warranties, and conditions relating to the Application and your use of the Application. We will not be liable to you for any direct, indirect, incidental, special, or consequential loss or damage arising out of or in connection with your use of the Application.
Our company shall not be held responsible for any interruptions in the service caused by factors beyond our control, including but not limited to interruptions caused by Anthropic and their Servers, Astica and their servers, Deep Infra and their servers, Elevenlabs and their servers, Groq and their servers, Lemonfox.ai and their Servers, Meta and their Whatsapp Cloud API, Amazon and their AWS infrastructure, Microsoft and their Azure infrastructure, PlayHT and their Servers, Serper.dev and their servers, Together Computer and their servers, OpenAI and their servers, and other similar factors. Additionally, we cannot be held responsible for local internet outages or any other unforeseeable circumstances that may interrupt the service. However, we will make every reasonable effort to address any issues that arise and provide prompt resolution whenever possible.
To the maximum extent permitted by law, we exclude all representations, warranties, and conditions relating to the Application and your use of the Application. We will not be liable for any direct, indirect, punitive, incidental, special, consequential, or exemplary damages, including without limitation, damages for loss of profits, goodwill, use, data, or other intangible losses, arising out of or relating to the use of, or inability to use, the Application. This exclusion applies whether the alleged liability is based on contract, tort, negligence, strict liability, or any other basis, even if we have been advised of the possibility of such damage.
Termination clauses
You may terminate your account and cease using the Application at any time. Upon termination, all data associated with your account will be deleted in accordance with our Privacy Policy. We reserve the right to suspend or terminate your account at our discretion for conduct that violates these Terms or is harmful to other users of the Application, us, or third parties, or for any other reason. Should your account be terminated, you will be notified via the email address associated with your account, and any data linked to your account will be removed as outlined in our Privacy Policy.
General
These Terms are governed by the laws of Germany and the European Union. If any provision of these Terms is found to be invalid or unenforceable, the remainder of these Terms will remain in full force and effect. These Terms constitute the entire agreement between you and us in relation to your use of the Application.
